And the craziest part? In some cases, it can be legally valid between the parties.

Here is the secret of the “Hidden Deed” and the “Spousal Super Loophole.”

I recently met a guy who said he owns a multi-million dollar house, but his name isn’t on the mortgage or registered with the county. He bought it from his brother.

They signed a private Grant Deed, put it in a drawer, and never recorded it. Why? Because if the bank found out about the ownership change, they might call the loan due and cancel that ultra-low 3% interest rate.

By keeping it unrecorded, he informally took over the payment, pays the cheap bill, and the bank may not see it immediately.

But what if you don’t want to hide in the shadows? What if a wife wants to buy a house off her husband and keep his cheap mortgage?

Most people think you have to apply for a new, expensive 7% loan. But there may be a better way to structure it. There is a federal law from 1982 that, in certain spouse or family transfer situations, may limit the bank’s ability to cancel the loan just because of the transfer.

You may be able to do it out in the open.

But here’s the genius part. If the wife doesn’t have millions in cash to buy him out, they layer it. She keeps the old, low-interest mortgage in place. Then, the husband acts as the bank for the rest of the money, setting up Seller Financing.

They may be able to register everything with the county, get title insurance, and legally preserve access to a low interest rate that almost doesn’t exist anymore.
